Terms of Use

These terms are the agreement between you and Crumbs Inc., a Delaware company ("Posty Crumbs", "we", "us"), for using the Posty Crumbs app, the share pages at postycrumbs.com, and related services (together, "the app"). By creating an account or signing in, you agree to them and to our Privacy Policy. If you do not agree, do not use the app.

1. Who can use Posty Crumbs

• You must be 18 or older. You confirm this when you sign up. If we learn an account belongs to someone younger, we remove it.
• You must be able to enter a binding contract, and the law where you live must not bar you from using the app.
• You must not have been removed from Posty Crumbs before. Coming back under a new account after a ban is itself a breach of these terms.
• One person, one account. Do not impersonate anyone else.

2. Your account

• You are responsible for your account and for everything done with it. Keep your password private and use one you do not use elsewhere.
• If you think someone else has got into your account, tell us straight away at hello@postycrumbs.com.
• You may not sell, rent, lend or transfer your account.

3. Your content

Posty Crumbs is built on what you post: photos, videos, voice notes, text, links and the places you pin them to ("crumbs"), plus comments, messages, your profile and your handle ("your content"). You keep ownership of your content.

The licence you give us. So the app can work, you give us a worldwide, royalty-free, non-exclusive licence to store, copy, show, distribute, resize, compress, caption, transcribe, translate, adapt and otherwise process your content, together with your handle, display name, profile picture, voice and likeness as they appear in it. This includes:

• showing a public crumb to other users, on the map, in trails, in clouds and on our web share pages, and in previews and notifications outside the app;
• making thumbnails, previews, subtitles, voice readings, map art and similar derived versions;
• running automated checks and tools on it, including AI, to moderate it, sort it into categories, suggest tags, and build features you choose to use (for example the cartoon-face effect);
• passing it to the companies that host and process it for us, such as our storage, video and AI providers, under this same licence.

We do not sell your content, and we do not license it to advertisers. The licence lasts for as long as your content is on the app. When you delete a crumb or your account, the licence for it ends, except: copies may remain in backups for up to 30 days; copies we must keep for safety or legal reasons; and content other people made in reply to it or that includes it, which stays theirs to the extent it is theirs.

What you promise. You have the right to post everything you post, including the rights of anyone who appears in it. You alone are responsible for your content. We do not check all content before it appears, we do not endorse it, and we do not promise it is accurate.

Feedback. Ideas, suggestions and bug reports you send us, including through the app's report tools, are voluntary. We may use them without owing you anything.

4. No tolerance for objectionable content

We do not tolerate objectionable content. The following are banned, and we remove them when we find them or they are reported to us:

• Harassment, bullying or threats against anyone, inside the app or outside it.
• Hate: attacks on people for their race, ethnicity, religion, gender, sexual orientation, disability, age or similar.
• Sexual content involving minors, in any form. There is no warning and no second chance. We delete the account and report to the authorities. Our child safety standards say more.
• Pornography or sexually explicit material in public crumbs. Artistic or non-sexual content that some people may not want to see must be marked NSFW by the author; unmarked content like this is removed.
• Graphic violence, gore, or content that glorifies self-harm.
• Illegal activity, or content that promotes it: drugs for sale, weapons, fraud, trafficking.
• Other people's private information: a home address, phone number, documents, or private images posted without consent. Pinning a crumb to a private home to target the person who lives there counts.
• Spam, scams and deceptive content, including fake accounts and bots.
• Content you do not have the right to post, including other people's copyrighted work (see section 8).

5. No tolerance for abusive users

We do not tolerate abusive users. If you harass, threaten, stalk, spam or repeatedly post banned content, we may remove your content, restrict your account, or delete it permanently, with or without warning. We may also report you to law enforcement where the law requires or allows it. We may remove any account that other users repeatedly and credibly report, and any account created to get around a ban.

6. Reporting and blocking

• Report. Every crumb, comment and profile has a Report option in its menu. Pick a reason and add a note. Reports are anonymous: we never tell the reported person who reported them.
• Block. You can block any user from their profile, from any of their crumbs, or from a message thread. Blocking hides their crumbs, comments and messages from you and hides yours from them, immediately.
• What we do. We review reports and aim to act within 24 hours. Reported content can be removed and the account can be restricted or deleted. Reports about children are handled first.
• Automatic checks. Photos posted in public are screened automatically before they appear. Anything flagged is held for human review.
• By email. You can also report anything to hello@postycrumbs.com. You do not need an account.

7. Things you cannot do

As well as the content rules above, you may not:

• use bots, scripts or automation to post, follow, like, message or otherwise act in the app;
• scrape, crawl, copy or collect content or data from the app, by hand or by tool, beyond what the app itself lets you do;
• try to get into another person's account or into any non-public part of our systems;
• upload viruses or malicious code, or interfere with, overload or disrupt the app;
• copy, modify, reverse engineer, decompile or make derivative works of the app, or use it to build a competing service;
• create fake accounts, buy or sell accounts, or misrepresent who you are;
• use the app to break any law or to infringe anyone's rights.

8. Copyright and takedowns

We respect other people's work and expect you to do the same. If you believe something on Posty Crumbs infringes a copyright or trademark you own or control, email our copyright agent at hello@postycrumbs.com with "copyright" in the subject line, or write to Copyright Agent, Crumbs Inc., Venice, California. Include: a description of the work; where the infringing content is (a share link or the crumb's author and place); your name, address, email and phone; a statement that you believe in good faith the use is not authorised; a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorised to act for them; and your physical or electronic signature. See 17 U.S.C. § 512(c)(3).

If we remove your content after a notice, we will tell you. If you think it was removed by mistake, you can send us a counter-notice with the information in 17 U.S.C. § 512(g)(3). Knowingly sending a false notice or counter-notice can make you liable for costs and damages.

We remove accounts that repeatedly infringe other people's rights.

9. Places and location

A crumb appears on the map only where its author chose to put it. Do not pin a crumb to a place in order to harass, expose or endanger someone. We never show anyone's live location.

10. Links and other people's content

Crumbs can carry links, songs, videos and previews from other websites and services. Those belong to their owners, not to us. We do not control them, we are not responsible for them, and using them is at your own risk. Content posted by other users is theirs, not ours; see section 3.

11. Our rights over content and accounts

We may remove any content and suspend or delete any account that breaks these terms, or that we believe is harmful to other users or to the service, at our discretion and without notice. We may change, pause or stop parts of the app at any time. If you think we removed something by mistake, the app lets you ask for a review, or you can email us.

12. Our property

The app, its name, logo, design, code, map art and everything we made are ours or our licensors', and are protected by law. We give you a personal, non-transferable, revocable licence to install the app from the App Store or Google Play on a device you own and to use it under these terms. That is the only right you get. You may not use our name or logo without our written permission.

13. Ending your account

You can delete your account at any time from Profile → Settings → Delete account. Deletion is permanent and removes your crumbs, comments, messages and uploads. If you cannot open the app, email us from the address on your account. We may suspend or end your account as described in sections 5 and 11. Sections 3, 7, 8, 14, 15, 16 and 19 continue to apply after your account ends.

14. Your responsibility to us

To the extent the law allows, you agree to defend and compensate Crumbs Inc., its officers, employees, contractors and service providers against any claim, loss, damage or cost, including reasonable legal fees, that arises from your content, your use of the app, or your breach of these terms or the law. We may take over the defence of any such claim, and you will cooperate with us if we do.

15. Disclaimers and limits on our liability

The app is provided "as is" and "as available". We do our best to keep it running and safe, but we cannot promise it will always be available, accurate or free of errors, or that content posted by other users is safe or true. To the fullest extent the law allows, we make no warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement.

To the fullest extent the law allows, Crumbs Inc. is not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits or data, arising from these terms or from the app, including from any content that is offensive, defamatory or illegal. Our total liability to you for any claim will not exceed the greater of one hundred US dollars ($100) or the amount you paid us in the twelve months before the claim.

Some places do not allow some of these limits. Where that is the case, they apply only as far as the law allows. Nothing here takes away rights the law gives you that cannot be waived.

16. Governing law and disputes

If you have a problem with us, please tell us first at hello@postycrumbs.com so we can try to sort it out. These terms are governed by the laws of the State of Delaware, where Crumbs Inc. is formed, without regard to its conflict-of-law rules. Any dispute that we cannot settle informally will be brought only in the state or federal courts located in Delaware, and you and we agree to those courts' jurisdiction.

17. Apple and Google

If you installed the app from the App Store, Apple's standard Licensed Application End User License Agreement also applies, and Apple is not responsible for the app or its content. If you installed it from Google Play, Google's terms apply in the same way.

18. Changes

We may update these terms. The date at the top tells you when they last changed. If a change matters, we will tell you in the app or by email. Continuing to use the app after a change means you accept it. If you do not accept it, stop using the app and delete your account.

19. Other terms

• These terms and the Privacy Policy are the whole agreement between you and us about the app.
• If a court finds part of these terms unenforceable, the rest still applies.
• If we do not enforce a term straight away, we can still enforce it later.
• You may not transfer your rights under these terms to anyone else. We may transfer ours, for example if the company is sold.
• The app has no paid features or advertising today. If we add any, separate terms will apply to them and we will show them to you first.
• Found a security problem? Email hello@postycrumbs.com with "security" in the subject line. Please give us a chance to fix it before telling others.
